Terms of Service
Version 1.0, November 5, 2026
These terms are between you and BD Nova UG (haftungsbeschränkt), Straße der Jugend 18, 14974 Ludwigsfelde, Germany. Merle is for businesses. By creating a workspace you confirm you are acting for a business, not as a consumer.
The service
Merle gives your product a feedback button and gives your team a place to decide what happens with each message, including creating issues in tools such as GitHub or Linear and telling customers about the outcome. Merle does not change your code.
Your account
Keep your sign-in secure. Admins decide who joins a workspace and are responsible for what its members do. You can delete a workspace at any time. It can be restored for 7 days, and is then erased.
Your data and your customers
What you and your customers put into Merle stays yours. We use it only to provide the service. You are the controller of your customers' data and we process it for you, as our Privacy Policy describes. You are responsible for telling your customers about the feedback button in your own privacy policy. A data processing agreement under GDPR Article 28 is available from support@hellomerle.com, and you can export your data from workspace settings.
Fair use
Don't use Merle to break the law, to send spam, to collect data you have no right to, or to attack or overload the service. We can suspend a workspace that does, and we will tell you why.
Plans and fees
Merle has a free plan with usage limits, shown in your workspace. Paid plans will show their price before you choose them. We will give you at least 30 days' notice before we change anything you pay for.
Availability
We work to keep Merle running, but we don't promise it will never be down, and the free plan comes with no guaranteed availability. Customer messages are stored before any other step, so an outage in a connected tool does not lose them.
Liability
We are liable without limit for intent, gross negligence, and injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breach of an essential contractual duty, limited to the damage typical and foreseeable for this kind of contract. Any other liability is excluded.
Ending
You can stop at any time by deleting your workspace. We can end the service for you with 30 days' notice, or at once for a serious breach of these terms.
Changes and law
We will tell workspace admins about changes at least 30 days ahead. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Courts at our registered office have jurisdiction, as far as the law allows.
